About these terms
These terms are an agreement between Path Profiler (“we”, “us”, “our”) and you, the person using this website (“you”). They cover the pages on this site and the founder profile assessment we offer here. If you do not agree with them, please do not use the assessment.
What Path Profiler is
Path Profiler is a free online questionnaire. You answer a short profile form and a series of questions, and we score your answers to produce a founder profile with suggested directions and related offers. The result is informational and educational only. It is not professional, financial, legal, tax, medical or career advice, it is not a psychometric diagnosis, and it does not predict or guarantee any business outcome. Decisions you make after reading your result are your own.
No accounts, no payments
The assessment does not use accounts, passwords, memberships, subscriptions or billing. We do not sell anything on this website and we never ask you for payment card details here. Your progress is tied to your browser session, and your finished result is reachable through a unique link that we show you and email to you. Anyone with that link can view that result, so treat it as private.
Who may use the assessment
The assessment is written for adults thinking about starting a business. Age is an optional field on the profile form and we do not verify the age or identity of anyone who takes the assessment. The website is not directed at children.
The information you give us
You are responsible for the accuracy of what you submit, including your name, email address, phone number and postal code. Submitting someone else’s contact details, or deliberately false details, is not permitted. How we handle the information you provide is described in our Privacy Notice.
Communications you agree to receive
When you tick the consent box on the profile form, you agree to receive your assessment result plus related recommendations, offers and business content from us by email, SMS text message and phone. We record the exact wording you agreed to, along with the time and the IP address the consent came from.
Where you provide “prior express written consent” within the meaning of the Telephone Consumer Protection Act (“TCPA”), you consent to receive telephone calls, including artificial voice calls, pre-recorded messages and calls delivered via automated technology, and text and SMS messages at the number you provided. Consent is not a condition of any purchase. Message and data rates may apply and message frequency varies. Reply STOP to any text message to stop further messages, or HELP for help. Every marketing email includes an unsubscribe link, and you can also email us at [email protected] to be removed. Mobile carriers are not liable for delayed or undelivered messages.
Advertiser disclosure and third-party offers
Your result page and the analysis screen can show offers from third parties. When you click one of these offers we record the click and send you on to the advertiser’s own website; we do not pass your name, email address or phone number in that link. We may be paid when you click an offer or sign up with an advertiser, which can influence which offers we show and the order they appear in. We do not control advertisers, we do not endorse their products, and any dealings you have with them — including their terms, prices and privacy practices — are between you and them.
Acceptable use
You agree not to use this website: for any unlawful purpose; to submit false or misleading information or someone else’s contact details; to send automated, scripted or bulk submissions, or to defeat the anti-bot and rate limiting we use on the form; to scrape, spider or copy the questions, scoring or content; to interfere with or probe the security of the site; or to upload anything malicious. We may block access, discard submissions and remove data when we believe this section has been breached.
Intellectual property
The questions, scoring model, profile descriptions, copy, design and logos on this website belong to Path Profiler or our licensors. Using the assessment does not transfer any of those rights to you and does not grant you a licence to reproduce them. You may keep and share your own result for personal, non-commercial use.
Availability and changes to the assessment
We may change, pause, or withdraw the assessment, the questions, the scoring or any offer at any time and without notice. We do not promise that the website will be available uninterrupted or free of errors, and we may have to take it offline for maintenance.
Disclaimer of warranty
The website and the assessment are provided on an “as is” and “as available” basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that your result will be accurate, complete, suitable for your circumstances, or useful to you.
Limitation of liability
To the fullest extent permitted by applicable law, Path Profiler and its officers, employees, agents, suppliers and licensors will not be liable for any indirect, incidental, special, punitive or consequential damages, or for lost profits, revenue, goodwill or business opportunity, arising from your use of the website, your result, or any third-party offer you reach from it. Because the assessment is free, our total liability to you for all claims relating to it is limited to one hundred US dollars (US$100). Some jurisdictions do not allow these limits, in which case they apply to you only as far as the law permits.
Indemnification
You agree to indemnify and hold Path Profiler and its affiliates, directors, officers, employees and agents harmless from any liabilities, losses, damages or costs, including reasonable legal fees, arising from information you submit, your use of the website, or your breach of these terms.
Severability
If any part of these terms is held to be unenforceable, that part is limited or removed to the minimum extent necessary and the rest of the terms stay in force.
Governing law
These terms, and any dispute arising out of them, are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. The state and federal courts located in New York have exclusive jurisdiction, and you submit to the personal jurisdiction of those courts.
Changes to these terms
We may update these terms. When we do, we post the new version on this page and change the “Last updated” date shown at the top. Continuing to use the website after a change means you accept the updated terms.
